Speymalt Whisky Distributors Ltd t/a Gordon and MacPhail (registered in Scotland with company number SC037522) is the operator of this website, and the data controller with responsibility for your personal data (collectively referred to as “G&M”, “we”, “us” or “our” in these terms).

The Cairn Distillery is owned by Gordon and MacPhail.

Online Bookings and Website

We will endeavour to provide information on our booking platform (provided by Appointedd), and what is displayed on our website is current and accurate. It is important to understand that we are not liable for any errors. Use of the website and booking platform is subject to different terms of use. In the case of conflict, the terms below will apply to online booking of tours and/or events.

When full payment has been made online, you will receive an automated booking confirmation for your chosen event/tour; this will also secure a place(s) for you and your party on the specified event/tour.

If you do not receive an automated confirmation email, please contact us via email at info@the cairndistillery.com. We will check the email address and booking before resending your booking confirmation(s). We accept no responsibility for the incorrect inputting of an email address on our booking platform. When the booking confirmation email has been received, it is your responsibility to check the details of the booking are accurate and correct.

Pricing and Admission Policy

The price advertised on the booking platform is the price of the event/tour. We do not offer concessions, and all prices shown are inclusive of VAT (where VAT is applicable). The Cairn Distillery, owned by Gordon and MacPhail, (referred to as "The Cairn"), reserves the right to amend the price of an event/tour, at any time.

All events/tours are to be pre-paid in full at the time of booking, and the only exception is for our Voyager’s tour.

Conditions of Entry

In line with the ‘Challenge 25’ policy, guests may be subject to an age check on arrival to the event/tour. Those who possibly look under 25 should bring photo identification (ID) (e.g. passport or driving licence) with them to their booking. We ask that all guests be wearing appropriate footwear, no heels and preferably closed toe shoes. Guests with inappropriate footwear may not be permitted to access certain parts of the tour.

To attend the event/tour you must be over the legal drinking age in the UK. We reserve the right to verify your age prior to, at or during the event/tour.

Children (those under the age of 18) are permitted entry to our onsite restaurant, The Gathering but they are not permitted to join a tour of the distillery.

In the instance a guest is unable to provide a valid photo ID, The Cairn reserves the right to refuse the guest entry or ask them to leave the event/tour and regrets that no refunds can be given in this instance.

The date, time and location of the event/tour will be clearly stated on your booking confirmation. Please ensure you have double checked your date and time as we may not be able to amend your booking. We ask that all guests arrive in good time for their booked event/tour. The Cairn asks that all guests arrive at least 10 minutes prior to the event/tour start time. If you arrive late there may be provision for you to join the tour part-way through on your arrival, or have the choice to join a later tour, however we cannot guarantee this and no refund will be provided.

Walk-In Bookings

Walk-in bookings are welcome at The Cairn and are subject to availability of the preferred event/tour. Pre-booking is recommended to avoid disappointment for your preferred event/tour.

Cancellations and Amendments

If the event/tour is cancelled by The Cairn, you will be entitled to a full refund.

Should you wish to cancel or reschedule a booking, please do so by amending you booking online or by emailing us at info@thecairndistillery.com or by phoning us on 01309 675968, during business opening hours and at least 24 hours before the event/tour is scheduled. (You can find our business opening hours online at our website). If the event/tour is cancelled by you within 24 hours of the event/tour start time, there will be no refund.

Our Liability To You:

THE CUSTOMER'S ATTENTION IS PARTICULARLY DRAWN TO THIS CLAUSE

We shall not be liable to you for the following types of loss:

(a)         loss of profits.

(b)         loss of sales or business.

(c)         loss of agreements or contracts.

(d)         loss of anticipated savings.

(e)         loss of use or corruption of software, data or information.

(f)          loss of or damage to goodwill; and

(g)         indirect or consequential loss.

Nothing in these terms limits any liability which cannot legally be limited, including liability for:

(a)         death or personal injury caused by negligence;

(b)         fraud or fraudulent misrepresentation; and

(c)         breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession).

Nothing in this clause shall limit the customer's payment obligations.

Subject to the above, The Cairn’s total liability to the customer shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.

Unless the customer notifies The Cairn that it intends to make a claim in respect of an event within three months of the event happening, The Cairn shall have no liability for that event. The notice period for an event shall start on the day on which the customer became, or ought reasonably to have become, aware of the event having occurred. The notice must be in writing and must identify the event and the grounds for the claim in reasonable detail.

The Cairn shall not be liable for any failure or delay in performing its obligations under these terms and conditions if such failure or delay is caused by circumstances beyond its reasonable control (Force Majeure Event). Our performance under these terms and conditions is to be deemed to be suspended for the period that the Force Majeure Event continues. The Cairn will endeavour to bring the Force Majeure Event to a close or find a solution by which our obligations under these terms and conditions may be performed despite the Force Majeure Event.

Personal Belongings

The Cairn shall not be liable for any loss, damage, theft, or destruction of personal belongings, inclusive of cars, or property left unattended or stored in our facilities, including The Cairn’s designated area provided.

The Cairn car park closes every evening and overnight parking is not permitted. If we remove your car from the car park after it has closed you will be required to pay our costs for doing so.

Your Privacy

Any personal data provided by you to The Cairn as part of the booking process for the event/tour, as well as attending, will be treated securely and confidentially.  It is recommended that you review our privacy policy for more information about how we process your personal data, and your rights in relation to your own personal data.

Guest Conduct

While visiting The Cairn, guests must observe the following:

• Guests are responsible for orderly conduct and will ensure that nothing shall be done which may constitute a breach of the law or cause a nuisance in any way.

• Smoking and/or vaping is not permitted inside The Cairn and is only allowed in designated outdoor areas.

• No pets or animals are permitted inside The Cairn, except for assistance dogs. Please ensure you notify the team in advance if you or someone in your party have an assistance dog as there are parts of the event/tour whereby an alternative arrangement needs to be made. • Be aware of the Zero tolerance in Scotland for drinking and driving. For more information, please visit the Government website and the Drink Aware website.  The Cairn will provide a driver pack (for designated drivers to take alcoholic products away to enjoy at a later time) for those who are the designated driver.

• Staff at The Cairn reserves the right to remove anyone from the event/tour if their behaviour is deemed likely to cause offence, put staff or other guests at risk or be a nuisance to guests and staff.

Photography

The Cairn or other authorised third parties may take photos or other recordings while you are at an event or on a tour, which may feature guests. Should you not wish to feature in any photographs, you must let us know in advance.

You can take photos outside the distillery and certain areas inside the distillery but not all. Please conform to your tour guides requests in this regard.

Also please be aware that you may appear in others’ photos – which is out of our control and if you are uncomfortable with this ensure you make it clear to your tour group before commencing your tour.

Complaints

In the unlikely circumstance that you may wish to make a formal complaint in respect of the event/tour please inform a member of The Cairn team. If the matter is unable to be resolved immediately, or during the event/tour, despite the staff member’s endeavours to do so, your complaint should be made in writing to our head office by email: info@gordonandmacphail.com We will investigate your complaint as soon as is reasonably possible, and will endeavour to reply in seven days.
